These Terms of Service ("Terms") govern your access to and use of the LeanPivot.ai website and platform, including our AI assistant PivotPal, plan generators, and all related services. By creating an account or using our services, you agree to abide by these Terms, so please read them carefully. If you don't agree, please don't use LeanPivot.ai.
1. Using Our Service
Eligibility
You must be at least 18 years old (or the age of majority in your country) to use LeanPivot.ai. By using the platform, you represent that you meet this requirement and that the information you provide during signup is accurate and truthful.
Account Security
You're responsible for keeping your login credentials confidential. Please use a strong password and keep it safe. If you suspect any unauthorized use of your account, let us know immediately. We are not liable for any loss or damage from your failure to secure your account.
Acceptable Use
LeanPivot.ai is here to help you build your startup, so we ask that you use it responsibly. You agree not to misuse our services. This means you will not:
- Violate any applicable laws or regulations while using PivotPal or other features.
- Attempt to hack, overload, or disrupt the platform (no DDOS, malware, or reverse engineering our software).
- Upload or input content that is illegal, harmful, or infringes on anyone's rights. For example, no hate speech, harassment, intellectual property infringement, or confidential data that you don't have permission to use.
- Use PivotPal to generate spam, misleading information, or any content intended for malicious purposes.
- Attempt to bypass any usage limits or security features we've put in place.
When participating in our community spaces (including forums, discussions, webinars, and any other user interaction features), you must also follow our Community Guidelines, which provide detailed standards for interaction with other users.
We reserve the right to suspend or terminate your access if you violate these rules or otherwise harm the integrity of the service or its users.
2. Subscription and Fees
Plans and Billing
LeanPivot.ai offers free and paid subscription plans based on startup stages (Ideation, Validation, MVP, Launch, Growth, and Funding tiers). You can view current pricing on our Pricing page. If you sign up for a paid plan, you agree to pay the fees indicated for that plan. Payments will be charged on a periodic basis (monthly or annually) as per the plan terms, and will auto-renew until you cancel. All fees are in USD and are generally non-refundable except as required by law or our refund policy.
AI Credits and Usage Limits
Some features may consume AI credits or have usage limits based on your subscription tier. We'll clearly indicate credit costs and remaining balances in your account. If you exceed your plan's limits, you may need to upgrade or wait for the next billing cycle.
Free Trials and Beta Access
If you start with a free trial or have beta access, you'll get access to paid features for a limited time. Once the trial ends, if you haven't chosen a paid plan, your account may revert to a free feature-limited version. We'll remind you via email when your trial is nearing its end.
Upgrades, Downgrades, and Cancellation
You can upgrade, downgrade, or cancel your subscription at any time through your account settings or by contacting support. Changes typically take effect at the next billing cycle, though upgrades may be prorated. If you downgrade, you might lose access to some features from the higher tier. Cancelled subscriptions remain active until the end of the current billing period.
Payment Issues and Account Suspension
If a payment fails (e.g., expired credit card), we'll notify you and provide a grace period to update your payment information. If fees remain unpaid after the grace period, we may suspend or downgrade your account. You are responsible for any applicable taxes, bank fees, or currency conversion charges.
3. Intellectual Property
Our Content
LeanPivot.ai (and its underlying software, algorithms, and content) is owned by us (LeanPivot Solutions, LLC and its licensors) and protected by intellectual property laws. This includes the PivotPal AI prompts, plan generator templates, the design of the platform, logos, and any text or materials we provide. You agree not to copy, distribute, reverse engineer, or create derivative works from our content without our written permission.
Your Content
You retain ownership of any content you submit to the platform - including business ideas, chat messages, documents you upload, vault content, and any data you input into our plan generators. We do not claim ownership of your ideas or intellectual property. However, by using our service, you grant us a limited, non-exclusive license to use your content as needed to operate and improve the service (such as processing your inputs to generate responses, storing your data on our servers, and analyzing usage patterns to improve our AI models). We will not share your confidential business ideas with other users or make them public without your explicit consent.
AI-Generated Content
The answers, drafts, or suggestions PivotPal provides are generated by AI based on the information you give. You are free to use this AI-generated content for your personal or commercial purposes (after all, it's here to help your startup!). We simply advise that you review and refine it as needed, since AI might not always get things perfect.
4. AI-Generated Content and Disclaimers
Nature of AI-Generated Content
Our AI features (including PivotPal and plan generators) provide suggestions, content, and guidance based on lean startup methodology and general business best practices. However, AI-generated content should be considered starting points for your own analysis and decision-making, not final answers or professional advice.
No Professional Advice
LeanPivot.ai does not provide legal, financial, accounting, tax, or other professional advice. AI-generated content should not be relied upon as a substitute for professional consultation. Always consult qualified professionals when making significant business, legal, or financial decisions.
AI Limitations
While we strive for accuracy, AI models can make mistakes, produce outdated information, or generate content that may not be suitable for your specific situation. You should review, verify, and adapt all AI-generated content to your unique circumstances. We are not responsible for decisions made based solely on AI-generated content.
5. Warranty Disclaimer
We provide LeanPivot.ai to you "as is" and "as available". While we aim for excellence, we make no warranties that the service will be uninterrupted, error-free, or suitable for your specific needs. For example, we do not guarantee that using PivotPal will result in funding, market success, or any particular outcome for your startup. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Data and Privacy
Data Processing
We process your personal data in accordance with our Privacy Policy. By using LeanPivot.ai, you consent to such processing and warrant that all data provided by you is accurate. We use secure, industry-standard practices to protect your data.
Data Retention and Deletion
We retain your account data while your account is active and for a reasonable period afterward as described in our Privacy Policy. You may request account deletion at any time through your account settings or by contacting support. Upon deletion, we will remove your personal data in accordance with our data retention policy and applicable law.
International Users
If you are accessing LeanPivot.ai from outside the United States, you understand that your data will be transferred to and processed in the United States. By using our service, you consent to such transfer and processing.
7. Limitation of Liability
In no event will LeanPivot Solutions, LLC (or its founders, employees, partners, or affiliates) be liable for any indirect, consequential, exemplary, or special damages, or for any loss of profits or revenues, business interruption, or loss of data, arising out of your use of (or inability to use) the service, even if we have been advised of the possibility of such damages. Our total liability for all claims related to the service is limited to the amount you paid us in the past twelve months for that service (or $100, if you haven't had any paid subscriptions), whichever is greater. Some jurisdictions don't allow certain liability exclusions, so parts of this section may not apply to you - but our liability is limited to the fullest extent the law allows.
8. Termination
You're free to stop using LeanPivot.ai at any time. Likewise, we reserve the right to suspend or terminate your access if we have reason to believe you've violated these Terms, or for any other reason in our sole discretion (for example, if required by law or if we discontinue the service). If your account is terminated (by you or us), you may lose access to content or data provided through the platform, and we may delete your information (in accordance with our Privacy Policy). Sections of these Terms that by their nature should survive termination (like intellectual property rights, disclaimers, and liability limitations) will continue to apply.
9. Changes to These Terms
We may update or modify these Terms from time to time. If a change is significant, we'll do our best to notify you (for example, via email or a notice on our site). By continuing to use LeanPivot.ai after updates come into effect, you agree to the revised Terms. If you don't agree with the changes, you should stop using the platform.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction where our company is established (without regard to conflict of law principles). By using the service, you agree to submit to the personal jurisdiction of such courts for the purpose of resolving any disputes.
11. Referral and Affiliate Programs
Referral Program
LeanPivot.ai operates a referral program where users can earn rewards (such as coins or account credits) for referring new users. Referral rewards are subject to terms and conditions that may change over time. We reserve the right to modify or discontinue the referral program at any time.
Affiliate Partnerships
We may recommend or link to third-party products or services through affiliate programs. If you click an affiliate link and make a purchase, we may receive a commission at no additional cost to you. We only promote products we believe add value for entrepreneurs. However, any transaction with an affiliate partner is solely between you and that third party. LeanPivot.ai is not responsible for issues, disputes, or liabilities arising from such transactions. Please review affiliate partners' terms and privacy practices before engaging.
Blog and Content Monetization
